Our terms and conditions

Visa

The client is responsible for obtaining any Visa needed to enter The Kingdom of Thailand or any other country booked via Yaya Asia Travel Co., Ltd. All deposits and or booking fees incurred to book holidays will be deemed non refundable if the client can not or will not obtain a pertinent Visa for the respective countries they plan to visit.

Changing

A booking and confirmed program that has been done via email is possible to change if everything is still available on your new dates. Changing costs are 200 Baht per item (hotels, tours, transfers and tickets) with a maximum of 2.000 Baht depending on price availability of new tickets if needing to be issued.

While on tour, changing a program is possible with the same conditions as above. Some hotels, depending on the season of the vacation, will charge a cancellation fee of one night or more depending on their contract and some tour companies will also have a cancellation costs. These cases have to be done on a case to case basis.

Complaints

We do all we can to ensure you have an enjoyable vacation. We welcome your feedback and are always here to listen to you.

Should you have any complaints about your vacation, and/or our services, we ask you to bring this to our attention as soon as possible and no later than 30 days after the occurrence of the complaint. We request that you send us the complaint via email (short and precise). Please note that complaints received later than 30 days after occurrence, or complaints via telephone or fax will not be processed. If a refund is granted repayment will take place between one to two months after the confirmation of the refund is sent.

If you have paid via Credit Card, refunds would be done via money transfer from our account in Thailand or Holland to your bank account in your home country and will be done in the exchange used for the initial payment, refunds cannot be done via credit cards. Please note that all fees associated with sending the funds back to your home account are the responsibility of the client and not from Yaya Asia Travel Co.,Ltd.

Yaya Asia Co., Ltd. reserves the right to make changes in any route, itinerary, accommodation and excursions due to weather or outside influences. Your safety and comfort are our priority.

Tour Fees

Most tours mentioned on our website are per person and apply to a minimum of two persons. For most multi-day tours a single supplement applies for our single travellers.

The hotel rates are per room, not per person. Furthermore, the prices are based on exchange rates and taxes as they were known at the time the particular tour was calculated.

Yaya Asia Co., Ltd. reserves the right to change the price due to exchange rates or tax increases. If the price has to be changed then the client will, as soon as possible, but no later than the seventh day before the day of departure, be informed of these changes. With an increase of more than 15 percent of the total amount, the client is entitled to cancel the tour contract with entitlement to a refund of monies already paid. The client is expected to inform us of their wishes no later than 5 days before arrival.

The tour cost includes: all transportation, services and facilities, indicated in the description of the tour, except: insurance, taxes, cost of travel documents such as visas, tours and transportation not mentioned in the tour description and personal expenses.

The amount of the holiday must be paid six weeks before the day of departure and in possession of Yaya Asia Co., Ltd. For late payment, the traveler is in default. Yaya Asia Co., Ltd. will inform the client in writing. The customer still has the possibility to pay the amount due within three working days to maintain the holiday booking. If no payment is made after these three working days, the contract is deemed to be canceled on the day of default. If any deposit is needed before the six weeks than this will be calculated and passed on to the customer.

Liability

By entering into the travel agreement indemnifies the participant Yaya Asia Co. Ltd. and with the Yaya Asia Co., Ltd. collaborate agencies has no liability for damage caused by theft, loss, injury or accident caused to the client (s)regardless from any cause, except for the direct liability of the legal entity for gross negligence or willful misconduct. Also liability is excluded for damages resulting from the use of any posted property, including planes, cars, hotels, swimming pools etc. and damage suffered by delays due to mechanical failure, forced cross-border movements, natural disasters, revolution, acts of war, strike, illness, quarantine or not the (travel) organizations causes.

When changes and / or delays in flight schedules of the booked trip due to technical problems, strikes and / or weather conditions, the conditions of the International Carriage for scheduled air travel in accordance with the Warsaw Convention applies.

Yaya Asia Travel encourages all customers to arrange their travel, medical, cancellation and other types of insurance policies in their home country. This kind of insurance can not be arranged in Thailand or Southeast Asia. Make sure that your Insurance has global coverage. Check if it offers global coverage!

Cancellation

If you have paid for your holidays and you need, or want, to cancel than the following will apply.

Effective upon receipt of written notification, are subject to the following penalties of the full trip price (The cancellation costs are subject to any flight, train, boat or bus tickets that we have issued for you):

30% non-refundable deposit due at the time of confirmation
90-61 days prior to arrival: 50% penalty
60-46 days prior to arrival: 75% penalty
45 days prior to arrival: 100% penalty
Upon repayment of money Yaya Asia is not liable for money exchange fluctuations and transfer costs that the banks charge. Repayment will take place between one to two months after the confirmation of the cancellation is sent.

If you have paid via Credit Card or Pay Pal, refunds would be done via money transfer from our account in Thailand or Holland to your bank account in your home country and will be done in the exchange used for the initial payment, refunds cannot be done via credit cards or via Pay Pal.

For payment,we accept all major credit cards (MasterCard, Visa, American Express) and wire transfers*.

*Discounts apply when paying via wire transfer.

At time of confirmation we request a minimum deposit of 30%. If we have to do a prepayment to confirm an aspect of your booking such train, flight, bus tickets or some accommodation, than there is a possibility that we might request a bigger deposit. This will be calculated on a case by case basis.

The balance of your holidays would be due 60 to 90 days before arrival depending on the season during your arrival.

Governing Law & Jurisdiction:

Any legal relationships where Yaya Asia Co. Ltd. is involved, the Thai law will exclusively apply, also if a commitment wholly or partly abroad in another country, or if the party is domiciled in another country, the Thai law will prevail.

All disputes arising from the agreement or its related contracts will be send to the relative court in Thailand. Notwithstanding, Yaya Asia Co. Ltd. has the right to take legal action against the other party in the jurisdiction in which the other party is resident.
